German corporation claims Farm Foodstore allegedly sold counterfeit products using its trademark

MIAMI — A German corporation has filed suit against a retailer for alleged trademark infringement regarding its handcrafted water pipes.

Roor filed a complaint on Aug. 10 in the U.S. District Court for the Southern District of Florida against Corner Store Corp. of Delreay Beach, doing business as Farm Foodstore, alleging that the retailer violated the Lanham Act.

According to the complaint, the plaintiff alleges that Roor is the owner of a trademark registered to the United States Patent and Trademark Office, which is associated with handcrafted water pipes. The plaintiff claims the defendant does not have the plaintiff's consent to sell products that are not genuine or counterfeit products. The plaintiff claims that this caused damage to the trademark and also to the Roor name. The plaintiff holds Corner Store Corp. of Delreay Beach responsible because the defendant allegedly gained profit from selling counterfeit products and deceived consumers into believing that they were buying authentic Roor products

The plaintiff requests a trial by jury and seeks judgment against the defendant, award an accounting for profits, damages, attorney's fees and costs of suit and any further relief as the court deems just. It is represented by Anthony J. Badway of The Ticktin Law Group PLLC in Deerfield Beach.
