Ace American Insurance Co. accused of breach of contract in boat lawsuit

TAMPA – Two Hillsborough County corporations have filed suit against an insurance company after a lawsuit over work done on a boat.

Angell Marine Inc., as assignee of Lazzara Marine Enterprises Inc., filed a complaint on Aug. 11 in the 13th Judicial Circuit Court - Hillsborough County against Ace American Insurance Co. alleging breach of contract.

According to the complaint, Angell Marine purchased a boat and paid Lazzara $200,572.25 to service it. Angell claims that following the work, the boat was unable to reach plane and was taken to another company for remedial work. The suit states that the boat was damaged by the work Lazzara did on it, and that Angell was forced to sell the boat. Angell filed a suit against Lazzara, and Lazzara asked defendant Ace, its insurer, to defend and indemnify it, according to the suit.

The plaintiffs hold Ace American Insurance Co. responsible because the defendant allegedly denied to defend and indemnify Lazzara and allegedly failed to provide insurance coverage for the damages sustained by Angell.

The plaintiffs attorney's fees and costs and all other relief as the court deems just. They are represented by Derek J. Angell of O'Connor & O'Connor LLC in Winter Park.
