Plumber files claim against former employer for alleged unpaid overtime wages

TAMPA — A plumber has filed a class-action lawsuit against The Drain Team Inc and Peter Maccio for alleged unpaid overtime wages.

Former employee Jonathan Couri filed a complaint on behalf of and for those similarly situated on Aug. 11 in the Tampa Division of the Middle District of Florida against the defendants, alleging that they violated the Fair Labor Standards Act (FLSA).

According to the complaint, the plaintiff alleges that from Dec. 15, 2014, to June 9, 2016, he was employed by the defendants as a plumbing service technician and was paid for jobs he performed by production basis, without any additional overtime premiums. Because of the acts of the defendants, plaintif, and those similarly situated, the plaintiff claims to have suffered damages and lost compensation. The plaintiff holds The Drain Team Inc and Peter Maccio responsible because the defendants allegedly failed to pay overtime compensation as required by the FLSA and have failed to maintain accurate records of work hours in accordance with the law.

The plaintiff requests a trial by jury and seeks judgment against defendants, unpaid wages, damages, interest, costs of suit, attorney's fees and other relief as the court deems appropriate. He is represented by Andrew Frisch of Morgan & Morgan in Plantation.
