MIAMI — A German-based manufacturer is suing Aziz Discount Food Stop and Beauty Supply Inc., a retailer, citing alleged trademark infringement.

Roor filed a complaint on Aug. 10 in the U.S. District Court for the Southern District of Florida against Aziz Discount Food Stop and Beauty Supply Inc., alleging that the retailer sold counterfeited products with the goal of trying to make a profit off of Roor's trademark.

According to the complaint, the plaintiff alleges that since Sept. 1, 2009, the plaintiff has been well-known for its trademark associated with handcrafted water pipes. In order to sell Roor's products, the products must first be purchased by the respective sellers from an authorized Roor agent, the suit states. However, the defendant was allegedly found to be selling counterfeit goods with the fake trademark. The defendant allegedly caused damage to the trademark and also to the Roor name by selling these products, which the plaintiff claims to be inferior. 

The plaintiff holds Aziz Discount Food Stop and Beauty Supply Inc. responsible because the defendant allegedly knew or should have known that the products they were selling are counterfeit and use confusingly similar marks.

The plaintiff requests a trial by jury and seeks judgment against the defendant, award accounted profits, damages, attorneys’ fees and costs and other relief the court deems reasonable. He is represented by Anthony J. Badway of The Ticktin Law Group PLLC in Deerfield Beach.
