Florida seaman alleges negligence against employer

FORT LAUDERDALE — A seaman is suing her employer, Blue Sea 1 LLC, citing alleged insufficient measures taken to prevent injuries and negligence after the captain of a vessel pushed her down the stairs.

Virgin Maria Olivera filed a complaint on Aug. 9 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Blue Sea 1, alleging negligence.

According to the complaint, the plaintiff alleges that on March 25, 2015, she sustained physical injuries on her neck, back and foot from being pushed down a flight of stairs. The plaintiff holds Blue Sea 1 responsible because the defendant allegedly failed to take appropriate actions against the captain of its vessel after the plaintiff's complaint.

The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of $250,000 plus interest, punitive damages, all legal fees and any other relief as the court deems appropriate. She is represented by Jacob Munch and Catherine Saylor of Munch and Munch P.A. in Tampa.
