Waitress alleges Diner 84 Inc. owes her unpaid overtime wages

MIAMI – A waitress alleges her former employer owes her unpaid overtime wages.

Wendy Sibinski filed a complaint on behalf of others similarly situated on Aug. 12 in the U.S. District Court for the Southern District of Florida against Diner 84 Inc. and Anestis Nikiforidis alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between March 2014 and July 24, she worked between 45 to 70 hours per week without being paid any overtime wages. The plaintiff holds Diner 84 Inc. and Nikiforidis responsible because the defendants allegedly failed to pay plaintiff any overtime premium rate of time-and-one-half for all hours worked that exceeded 40 hours per week.

The plaintiff requests a trial by jury and seeks compensatory and liquidated damages, all legal fees and interest, overtime wages owing to plaintiff, and any other relief as the court deems just.
