Former employee files claim against Xart Electric Inc. for alleged unpaid overtime

MIAMI — A former employee has filed a claim against Xart Electric Inc. and the company's president, Miguel Xart, for alleged unpaid wages resulting from overtime he claims he worked.

Cesar Perez filed a complaint on Aug. 8 in the U.S. District Court for the Southern District of Florida against the defendants, alleging violations of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Jan. 21, 2015, and Nov. 6, 2015, he worked more than 40 hours per week without being paid overtime wages. The plaintiff holds Xart Electric Inc. and Miguel Xart responsible because the defendants allegedly failed to pay any overtime premium for hours worked that exceeds 40 hours per week. 

The plaintiff requests a trial by jury and seeks compensatory damages, liquidated damages, interest, all legal fees, payment of overtime wages and other benefits wrongly denied, and any other relief as this court deems just. He is represented by Brian H. Pollock of Fairlaw Firm in Miami.
