Magan Rouse filed a complaint on Aug. 4 in the U.S. District Court for the Southern District of Florida against Morselife Home Care Inc., alleging that the home care institution failed to pay mandatory wages as required under state and federal law.
According to the complaint, the plaintiff alleges that in March 2015, she was employed by the defendant as an LPN and a non-exempt employee under the Fair Labor Standards Act (FLSA). She claims to have regularly worked more than 40 hours in a given work week and was entitled to overtime compensation for all hours worked in excess.
The plaintiff holds Morselife Home Care Inc. responsible because the defendant allegedly failed to compensate her for up to one and a half times her hourly rate for all worked performed in excess of 40 hours per week and violated the FLSA.
The plaintiff requests a trial by jury and seeks general, compensatory and liquidated damages, interest, attorneys’ fees, costs of suit and further relief as the court deems appropriate. She is represented by Cathleen Scott and Chelsea Bellew of Scott Wagner & Associates PA in Jupiter.
