ORLANDO – A Lake Mary woman alleges her insurance company wrongfully denied her disability benefits over claims that she is not disabled.
Arlene C. Burks filed a complaint on Aug. 4 in the U.S. District Court for the Middle District of Florida, Orlando Division against Liberty Life Assurance Co. of Boston alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she is disabled but the defendant denied her application for disability benefits in July. The plaintiff holds Liberty Life Assurance Co. of Boston responsible because the defendant allegedly denied or terminated plaintiff's disability claims based on their findings that she wasn't disabled according to the terms of the plan.
The plaintiff seeks payment of disability benefits, reinstatement to all other benefits, all legal fees and any other relief as the court deems just. She is represented by Gregory D. Smartwood of The Nation Law Firm LLP in Longwood.
