Woman alleges Sacred Heart Health System wrongfully terminated her

PENSACOLA – A Pensacola woman alleges she was wrongfully terminated and not properly paid by her former nonprofit employer.

Dianne R. Burgess filed a complaint on June 28 in the U.S. District Court for the Northern District of Florida, Pensacola Division against Sacred Heart Health System Inc. alleging violation of the Family and Medical Leave Act and the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she was wrongfully terminated on Dec. 7, 2015, after needing work restrictions after returning from FMLA-approved leave after a surgery. The plaintiff holds Sacred Heart Health System Inc. responsible because the defendant allegedly misclassified plaintiff in order to avoid paying her overtime wages and did not pay her for all hours worked or at a rate of time-and-one-half for hours worked over 40 per workweek.

The plaintiff requests a trial by jury and seeks back pay, front pay, liquidated damages, interest, all legal fees and any other relief as the court deems just. She is represented by R. John Westberry and Clayton M. Connors of Westberry & Connors LLC in Pensacola.
