Trust Mortgage alleged to have changed interest rate

MIAMI – A consumer alleges a debt collector tried to charge an unlawful interest rate.

Marie Petit-Homme filed a complaint on July 20 in the U.S. District Court for the Southern District of Florida against Trust Mortgage LLC alleging violation of the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, a final judgment in the plaintiff's foreclosure case was entered on Feb. 16, 2015, setting the interest rate at 4.75 percent. The plaintiff holds Trust Mortgage LLC responsible because the defendant allegedly charged an unlawful interest rate to plaintiff that was different from the rate that was prescribed in the judgment.

The plaintiff requests a trial by jury and seeks actual damages, statutory damages, all legal fees and any other relief as the court deems just. She is represented by Seth Wieder of Loan Lawyers LLC in Fort Lauderdale.
