Hard Candy files suit against CoverGirl makers alleging trademark infringement

MIAMI – A cosmetics company alleges an Ohio company manufactured its line of cosmetics with similar packaging.

Hard Candy LLC filed a complaint on July 18 in the U.S. District Court for the Southern District of Florida against The Procter & Gamble Co. alleging trademark infringement.

According to the complaint, the plaintiff alleges that the defendant's Katy Perry CoverGirl products launched this spring have a confusingly similar design to its products. The plaintiff holds The Procter & Gamble Co. responsible because it claims the defendant is attempting to confuse consumers and target its market share.

The plaintiff requests a trial by jury and seeks to enjoin the defendant; demand the defendant to destroy all infringing products and advertisement materials; award plaintiff damages, including general, special, actual, and statutory damages; punitive damages; all legal fees and interest; and any other relief as the court deems just.
