Woman alleges she was misclassified by Adler Realty Services, terminated in retaliation

FORT MYERS – An assistant property manager alleges that her former Collier County employer did not pay her overtime and terminated her employment after her complaints.

Anne Arbelaez filed a complaint on July 18 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Adler Realty Services LLC alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between January 2015 and June, she worked for more than 40 hours per workweek without being paid any overtime premiums by the defendant because she was misclassified as a salary employee. The plaintiff holds Adler Realty Services LLC responsible because the defendant allegedly failed and refused to pay plaintiff any overtime compensation and terminated her employment in retaliation on June 13 for complaining about the allegedly unlawful practice.

The plaintiff requests a trial by jury and seeks award of lost wages and benefits, back pay and benefits, compensatory damages, liquidated damages, reinstatement, interest, all legal fees and any other relief as the court deems just.
