MIAMI – A New York-based boutique operator alleges counterfeit versions of its products are being sold online.
Gucci America Inc. filed a complaint on July 15 in the U.S. District Court for the Southern District of Florida against sharegoods.co.uk, ukbags.top, et al., alleging trademark infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business as the result of counterfeit copies of its products being sold online by the defendants. The plaintiff holds sharegoods.co.uk, ukbags.top, et al., responsible because the defendants allegedly sold and promoted confusingly similar copies of plaintiff's products online.
The plaintiff seeks permanent injunction against the defendant, enjoin the defendant, pay plaintiff for all profits and damages derived from the unlawful act, $2 million as statutory damages per each counterfeit trademark, $100,000 per cybersquatted domain name used, all legal fees and interest, and any other relief as the court deems just.
