Frutera Del Litoral USA alleged to owe more than $200,000 for produce

MIAMI – A Miami business is accused of not paying for delivered produce.

Altafresh LLC, doing business as Chelan Fresh Marketing, filed a complaint on July 11 in the U.S. District Court for the Southern District of Florida, Miami Division against Frutera Del Litoral USA LLC, Carlos Mauricio Rueda Mesias, Francisco Dabike Armstrong and Diana Carolina Lascano Lozada alleging failure to pay promptly, breach of contract and other counts.

According to the complaint, the plaintiff alleges that between Oct. 16, 2015, and Jan. 18, it suffered damages to its business as the result of unpaid produce it delivered to the defendants. The plaintiff holds Frutera Del Litoral USA LLC, Carlos Mauricio Rueda Mesias, Francisco Dabike Armstrong, and Diana Carolina Lascano Lozada responsible because the defendants allegedly failed and refused to pay plaintiff for the produce they've received.

The plaintiff seeks $283,405.25 plus interest, enjoin the defendant from dissipating Perishable Agricultural Commodities Act trust assets, all legal fees and any other relief as the court deems just.
