Sales rep alleges she was misclassified by My Innovation Products

ORLANDO – A Kissimmee woman alleges she was misclassified as an independent contractor by her employer.

Yaris Burgos filed a complaint on July 1 in the U.S. District Court for the Middle District of Florida, Orlando Division against My Innovation Products LLC and Luis Carrasco alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that since the start of her employment as a sales representative with the defendants on Oct. 13, 2015, she has worked for more than 40 hours without being paid any overtime wages. The plaintiff holds My Innovation Products LLC and Carrasco responsible because the defendants allegedly misclassified plaintiff in order to avoid paying her any overtime compensation, did not deduct payroll taxes and did not keep accurate time records.

The plaintiff requests a trial by jury and seeks injunctive relief, unpaid wages, interest, all legal fees and any other relief as the court deems just. She is represented by Daniel A. Perez of Hogan & Hogan PA in Orlando.
