Miami-Dade County woman files suit for allegedly unpaid wages

MIAMI – A restaurant employee alleges that she wasn't properly paid and was retaliated against by her former employer.

Oneida J. Ruz filed a complaint on behalf of other similarly situated individuals on June 27 in the U.S. District Court for the Southern District of Florida, Miami Division against Mexzican Taqueria LLC, The Mexzican Gourmet LLC, Ze Carlos Jimenez and Claudia A. Varela alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Nov. 20, 2015, and April 2, she worked for more than 40 hours but was not paid any overtime wages. The plaintiff holds Mexzican Taqueria LLC, The Mexzican Gourmet, LLC Ze Carlos Jimenez and Claudia A. Varela responsible because the defendants allegedly failed to pay any overtime compensation to plaintiff as well as retaliated against her in the form of refusing to pay her the legal minimum wage when she complained about not receiving her proper wages. She also alleges Varela poured boiling water on her in April in retaliation and that she was discharged from employment and did not receive her last week's pay.

The plaintiff requests a trial by jury and seeks compensatory damages, liquidated damages, back pay and other benefits wrongly denied, all legal fees and any other relief as the court deems just. She is represented by Zandro E. Palma of Zandro E. Palma PA in Miami.
