Univista Holdings alleged to have not paid overtime

MIAMI – An insurance agent alleges a broker did not pay her overtime wages.

Yosdalis E. Garcia filed a complaint on June 27 in the U.S. District Court for the Southern District of Florida, Miami Division against Univista Holdings Inc. and Ivan Herrera alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between June 30, 2014 and Oct. 26, 2015, she worked for 62 hours every week but was not paid any overtime wages. The plaintiff holds Univista Holdings Inc. and Ivan Herrera responsible because the defendants allegedly failed to pay plaintiff any overtime compensation for all her hours worked in excess of 40 per week and wrongfully terminated her in October 2015 for complaining about her unpaid overtime wages.

The plaintiff requests a trial by jury and seeks compensatory damages, liquidated damages, back pay and other benefits, all legal fees and any other relief as the court deems just. She is represented by Zandro E. Palma of Zandro E. Palma PA in Miami.
