Villa Serena II Inc. alleged to have not paid overtime wages

MIAMI – An assisted living facilities worker has filed a class-action suit alleging he was not paid overtime.

Jose Antonio Martinez Marquez filed a complaint on behalf of all others similarly situated under 29 U.S.C. 216(b) on July 1 in the U.S. District Court for the Southern District of Florida against Villa Serena II Inc. and Roxana Solano alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between May 2 and June 24, he worked for an average of 134 hours per workweek but was not paid any overtime wages by the defendants. The plaintiff holds Villa Serena II Inc. and Solano responsible because the defendants allegedly failed to pay plaintiff any overtime compensation for all hours worked in excess of 40 per week.

The plaintiff requests a trial by jury and seeks double damages, all minimum wages still owing to plaintiff, all legal fees, interest, and any other relief as the court deems just. He is represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
