FORT MYERS – Two pool service technicians allege their employer did not pay them for overtime hours that they worked.
Diana Ward and Danielle Hufnagel filed a complaint on behalf of others similarly situated on May 23 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against MT Pools of SWFL Inc. doing business as Tri-City Pool Service & Supply Co., Michael Z. Tragakiss and Tara Record alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiffs allege that during their employment, they regularly worked for more than 40 hours per week without receiving proper overtime compensation. The plaintiffs holds MT Pools of SWFL Inc., Tragakiss and Record responsible because the defendants allegedly willfully failed to pay them overtime compensation at a rate of not less than one-and-one-half of their regular rate of pay for all hours worked in excess of 40 in a workweek.
The plaintiffs request a trial by jury and seek compensation for damages in the amount of unpaid overtime wages, liquidated damages, prejudgment interest, attorney's fees and costs and for all other relief as the court deems just and proper.
