Mid America Banking Corp. accused of telephone harassment

JACKSONVILLE – A Duval County consumer alleges a Missouri creditor robocalled him despite requests to stop.

Joseph Wilber filed a complaint on May 16 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against Mid America Banking Corp. alleging that the creditor violated the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff claims that in August 2015, he began receiving calls on his cellular telephone seeking to recover an alleged debt. During the conversation, he expressly revoked any express consent for the defendant to call him, the suit states. The plaintiff holds Mid America Banking Corp. responsible because the defendant allegedly intentionally harassed and abused him by calling several times in one day and on back-to-back days and made calls using an automatic telephone dialing system and/or pre-recorded or artificial voice. Despite actual knowledge of its wrongdoing, the defendant allegedly continued its barrage of phone calls to his cellular phone.

The plaintiff requests a trial by jury and seeks judgment against the defendant for all damages and any such other relief that the court may deem just and proper. He is represented by Amanda J. Allen of The Costumer Protection Firm PLLC in Tampa.
