FORT MYERS – A Sanibel consumer alleges that she has been denied credit due to an error on her credit report.

Susan J. Sadler filed a complaint on May 16 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Nationstar Mortgage LLC alleging that the credit reporting agency violated the Fair Credit Reporting Act.

According to the complaint, the plaintiff alleges that on Nov. 18, 2014, she was denied credit by Suntrust Bank due to the defendant's false and derogatory reporting of the bogus loan on her Experian credit report. She alleges this has caused her fear, anxiety, mental anguish and loss of sleep, and that she also suffered weakening of her credit worthiness and reduction on her credit score.

The plaintiff holds Nationstar Mortgage LLC responsible because the defendant allegedly erroneously reported a loan obligation that does not belong to her on her Experian credit report, failed to investigate and illegally obtained and used her Trans Union credit report.

The plaintiff requests a trial by jury and seeks compensation for all damages, attorney's fees and costs and such other relief as may be just and proper. She is represented by Christopher J. DeCosta of Holtz Mahshie DeCosta PA in Fort Myers; Thomas J. Lyons of Lyons Law Firm PA in Vadnais Heights, Minnesota; and Thomas J. Lyons Jr. of Consumer Justice Center PA in Vadnais Heights, Minnesota.
