Comenity Bank alleged to have made harassing phone calls

TAMPA – A woman is suing a creditor over allegations of abusive phone calls.

Jennifer McCambridge filed a complaint on May 5 in the Tampa Division of the Middle District of Florida against Comenity Capital Bank alleging that the creditor allegedly violated the Florida Consumer Collection Practices Act and the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that she continued to receive calls from the defendant to collect a purported debt even after she revoked any prior express consent to contact her on Jan. 14, resulting to her being abused and harassed. The plaintiff holds Comenity Capital Bank responsible because the defendant allegedly continued to make numerous telephone calls to her cellular telephone after being notified that she was represented by an attorney and made calls using an automatic telephone dialing system or an artificial or pre-recorded voice.

The plaintiff requests a trial by jury and seeks judgment against defendant for all damages, injunctive relief, costs of the action, together with reasonable attorney’s fees and any other relief that the court deems just and proper. She is represented by Christopher W. Boss of Boss Law in St. Petersburg.
