Lantana Texaco accused of restricting access to the disabled

MIAMI – A disabled person alleges that a Lantana business discriminated against him by denying access to and full and equal enjoyment of the goods, services and/or accommodations offered at the property.

James Mears filed a complaint on May 4 in the U.S. District Court for the Southern District of Florida against Texaco Tasin LLC and Prizm Enterprise LLC alleging that they allegedly discriminated against him, citing violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that in April, he visited the defendants' Lantana Texaco and Restaurant, where he encountered physical barriers to access the goods, services, facilities, privileges, advantages and/or accommodations offered therein. The plaintiff holds Texaco Tasin LLC and Prizm Enterprise LLC responsible because the defendants allegedly failed to remove physical barriers to access their property, failed to provide accessible route from the sidewalk to the accessible entrance of the property, failed to provide adequate accessible parking spaces and failed to provide restrooms that are accessible to and usable by individuals with disabilities.

The plaintiff requests a trial by jury and seeks permanent injunction enjoining defendants from continuing their discriminatory practices, order the defendants to remove the physical barriers and to alter the property to make it readily accessible to and useable by individuals with disabilities, reasonable attorneys' fees, litigation expenses and costs.
