MIAMI – An hourly assistant manager alleges that his employer did not pay him overtime wages.
Donald Taylor filed a complaint on May 4 in the U.S. District Court for the Southern District of Florida against Dollar Tree Stores Inc. alleging that the former employer violated the Fair Labor Standards Act.
According to the complaint, the plaintiffs allege that during his employment from May 5, 2013, through March 20, he worked for defendant on the average of 50 to 60 hours per week and was not paid for those extra hours worked in excess of 40 hours per work week. The plaintiff holds Dollar Tree Stores Inc. responsible because the defendant's management allegedly deliberately caused him to be clocked and to underreport his time, and willfully refused to make payment of wages owed to him.
The plaintiff requests a trial by jury and seeks compensation for unpaid overtime wages, liquidated damages, costs, attorney’s fees and any other remedy as the court may deem just and appropriate. He is represented by James M. Loren of Goldberg & Loren PA in Plantation.
