Lee County resident accuses Ocwen Loan Servicing LLC of telephone harassment

FORT MYERS – A Fort Myers consumer has filed a suit against a Tallahassee debt collector over allegations it has called him approximately 800 times.

Timothy Pink filed a complaint on April 25 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Ocwen Loan Servicing LLC alleging that the creditor allegedly violated the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that beginning in 2015, he began receiving calls to his cellular telephone from the defendant seeking to recover an alleged debt. He alleges the defendant called him several times in the same hour during one day and on back-to-back days. The plaintiff holds Ocwen Loan Servicing LLC responsible because the defendant allegedly made calls using an automatic telephone dialing system and/or an artificial or pre-recorded voice, and that none of the calls made were for emergency purposes. He claims the defendant also continued its campaign of abuse, calling him even after he revoked any express permission they may have had.

The plaintiff requests a trial by jury and seeks judgment against defendant for statutory, treble, punitive and actual damages and any other such relief as the court may deem just and proper. He is represented by Shaughn C. Hill of Morgan & Morgan, Tampa PA in Tampa.
