Man claims Cross Creek Barbecue has barriers to the disabled

JACKSONVILLE – A disabled Jacksonville man alleges that a Duval County restaurant has barriers at its property that have endangered his safety and denied him full and equal access.

Norman Hoewischer filed a complaint on April 21 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against Cross Creek Barbecue LC alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he encountered architectural barriers at the defendant's property, which substantially impaired his ability to safely access the goods and services offered therein. The plaintiff holds Cross Creek Barbecue LC responsible because the defendant allegedly failed to provide an accessible route to the building entrance, failed to provide accessible parking spaces, failed to provide a toilet room with the required 36-inch path of travel and other issues.

The plaintiff requests a trial by jury and seeks declaration that defendant violated the ADA, an order requiring defendant to make all readily achievable alterations, attorney's fees, costs and expenses and such other relief as the court may deem just and proper.
