Consumers allege they do not owe debt, file suit against Hunter Warfield

MIAMI – Two Indian River County consumers claim a debt collector continues to call them for a debt they do not owe.

Gloria Brustowicz and Eugene Brustowicz filed a complaint on April 18 in the U.S. District Court for the Southern District of Florida against Hunter Warfield Inc. alleging that the debt collection agency violated the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiffs allege that they received calls on their cellular telephones at least 11 times in an effort to collect the sum of $3,671, even though they claim they are not indebted to defendant. The plaintiffs holds Hunter Warfield Inc. responsible because the defendant allegedly knew that the debt is not legitimate, made calls using an automated telephone dialing system, reported the alleged debt to a credit reporting agency, continuously reported inaccurate and false information regarding Eugene Brustowicz's credit history and failed to correct and update his credit report.

The plaintiffs request a trial by jury and seek compensation for all damages, attorney's fees and costs and such other relief as the court may deem just and equitable. They are represented by D. John Rhodeback of Rooney & Rooney PA in Vero Beach.
