Passenger files suit against Royal Caribbean after breaking leg, alleging negligence

MIAMI – A Liberty of the Seas passenger is suing the cruise vessel's owner alleging the ship's movement caused her to break her leg.

Jacqueline Kulakowski filed a complaint on April 18 in the U.S. District Court for the Southern District of Florida against Royal Caribbean Cruises LTD citing negligence.

According to the complaint, the plaintiff alleges that on Oct. 5, 2015, she was ice skating in the ship’s skating rink when the ship was docked and stationary. The suit states that without warning the ship moved away from the dock suddenly, causing her to fall and break her leg.

The plaintiff holds Royal Caribbean Cruises LTD responsible because the defendant allegedly failed to implement a method of inspection which was reasonable and safe, inspect for and/or to observe passengers before moving the ship, failed to warn of the ship’s impending movement and failed to maintain the area and the premises in a safe and reasonable manner.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages suffered, including bodily injury, mental anguish, hospitalization and medical expenses; prejudgment and post-judgment interest; costs and attorney’s fees and for any and all other relief which the court may deem just or appropriate.
