Store manager accuses Charming Charlie LLC of wrongful termination

FORT LAUDERDALE – A former store manager has filed suit against a Broward County business alleging she was terminated while on leave for cancer treatment.

Lynette Loleski filed a complaint on April 13 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Charming Charlie LLC alleging violation of the Family and Medical Leave Act and retaliation.

According to the complaint, the plaintiff alleges that on Nov. 22, 2015, she used FMLA leave due to cancer that needed surgery, which was approved by the defendant. She alleges her employment was terminated on Feb.1, two weeks before her FMLA leave expired. The plaintiff holds Charming Charlie LLC responsible because the defendant allegedly illegally terminated her while she was on FMLA leave, failed to provide her the information so she could return with accommodation for chemotherapy, refused to allow her to return to work and retaliated against her for exercising her right to leave from work under the FMLA.

The plaintiff requests a trial by jury and seeks compensation for back pay, liquidated and monetary damages, attorney's fees and costs and all further relief that the court may determine to be just and appropriate. She is represented by Richard Celler of Richard Celler Legal PA in Davie.
