Orlando resident accuses Navient Solutions Inc. of telephone harassment

ORLANDO – An Orlando resident has filed suit against a debt collector over allegations it kept calling him after he requested the calls to stop.

Ollie Dawkins filed a complaint on April 4 in the U.S. District Court for the Middle District of Florida, Orlando Division against Navient Solutions Inc. alleging that the collection agency violated the Florida Consumer Collection Practices Act and the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that he received several unwanted telephone calls at a rate of two to three times a day, which incurred charges from his network provider, from the defendant in an attempt to collect a purported debt. The calls continued even after he revoked his prior express consent, the suit states. The plaintiff holds Navient Solutions Inc. responsible because the defendant allegedly made non-emergency calls using an automatic telephone dialing system and/or pre-recorded or artificial voice messages.

The plaintiff requests a trial by jury and seeks an order enjoining defendant from further violations of the FCCPA, compensation for statutory and punitive damages, reasonable attorney's fees and for such other relief that the court may deem just and proper.
