Collier County resident accuses Westlake Financial Services LLC of telephone harassment

FORT MYERS – A woman is suing a debt collector alleging that the company continued to call her after she requested it to stop.

Marjorie Solomon filed a complaint on March 30 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Westlake Financial Services LLC, alleging that the debt collector violated the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act provisions.

According to the complaint, the plaintiff alleges that since October 2015, she has received approximately 100 unwanted telephone calls from the defendant in an attempt to collect a purported debt. The plaintiff holds Westlake Financial Services LLC responsible because the defendant allegedly made calls several times during one day and on back-to-back days with the use of an automated telephone dialing system and/or a pre-recorded or artificial or voice messages. The defendant continued to call her even after her request to stop calling her, the suit states.

The plaintiff requests a trial by jury and seeks compensation for statutory, punitive damages, actual and treble damages, enjoinder from further violations of these provisions and any other relief that the court may deem just and proper.
