Suit filed against Beauty & Fragrance Emporium over allegedly selling unauthorized Arbonne products

JACKSONVILLE – An Irvine, California health and beauty product company has filed suit against a Jacksonville business alleging that it is selling, promoting and advertising its products without authorization.

Arbonne International Inc. filed a complaint on March 29 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against Beauty & Fragrance Emporium LLC and Anna Galka, also known as Anna Jackson, citing alleged trademark infringement, false advertising and unjust enrichment.

According to the complaint, the plaintiff alleges that it has suffered irreparable harm to its quality control procedures and to its goodwill. The plaintiff holds Beauty & Fragrance Emporium LLC and Galka responsible because the defendants allegedly purchased Arbonne products through Abronne independent consultants and then resold the products online. The plaintiff alleges because the products were sold without authorization, the products are not genuine.

The plaintiff requests a trial by jury and seeks an order prohibiting and enjoining defendants from advertising and selling all Arbonne products, an order prohibiting and enjoining defendants from using any of the Arbonne registered trademarks, requiring defendants to remove from their websites any reference to any Arbonne products, an award of attorneys' fees and costs and any further relief that the court may deem just, equitable and proper.
