Driver accuses UPS of terminating health care benefits while on FMLA leave

MIAMI – A driver alleges that his employer canceled his family's health care insurance while he was on leave.


Lenin Feliz filed a complaint on March 22 in the U.S. District Court for the Southern District of Florida, Miami Division against United Parcel Service Inc. alleging that the employer violated the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that the defendant allegedly canceled his and his dependents’ health care insurance while he was on FMLA leave to care for his newborn son, who was born in February. He alleges the defendant denied his request for the reinstatement of said health care insurance.

The plaintiff requests a trial by jury and seeks an order to reinstate him with full seniority to the same or any equivalent position, with back pay, plus interest, liquidated damages, punitive damages and all applicable benefits; reasonable attorneys’ fees and costs; prejudgment interest; and any further relief as the court may deem necessary and proper.
