Suit filed against AFNI in dispute over alleged debt

FORT MYERS – A Cape Coral man alleges that a debt collector engaged in unfair collection practices.


Joseph Ferris filed a complaint on March 16 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against AFNI Inc., citing violation the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that he received a letter from the defendant in April 2015 regarding a debt. The suit states that the plaintiff believes he does not owe the alleged debt and notified the defendant in writing that he disputes it. The defendant allegedly reported the debt on the plaintiff's credit report despite the fact that it still has not provided validation of the debt, and therefore the plaintiff argues that he has been damaged.

The plaintiff seeks the following: compensation for all damages; attorneys' fees and costs; and for any further relief that the court may deem just and proper. He is represented by Michael Jay Ringelheim of RC Law Group PLLC in Hackensack, New Jersey.
