Carmax Business Services sued over alleged violations of TCPA

ORLANDO – An Orange County consumer is suing a Tallahassee company over claims it has harassed her with repeated phone calls.

Cindy McGee filed a complaint on March 7 in the U.S. District Court for the Middle District of Florida, Orlando Division against Carmax Business Services LLC, citing violation of the Telephone Consumer Protection Act and the Florida Consumer Collections Practices Act.

According to the complaint, the plaintiff alleges that she has received numerous intrusive and unwanted telephone calls from the defendant in an attempt to collect a debt since 2013. The plaintiff holds Carmax Business Services LLC responsible because the defendant allegedly made non-emergency calls to her cellular telephone using an automatic telephone dialing system or pre-recorded messages, which is allegedly in violation of the TCPA.

The plaintiff seeks the following: compensation for all damages and any further relief that the court may deem just and proper. She is represented by Frank H. Kerney III of Morgan & Morgan PA in Tampa.
