Man claims former employer violated FMLA

ORLANDO — A man is suing his former employer, claiming alleged discrimination and wrongful termination.

Cristian Rondon sued McCorvey Sheet Metal Works, L.P., on March 7 in U.S. District Court for the Middle District of Florida Orlando Division, alleging that the company violated the Family and Medical Leave Act.

The plaintiff claims he was improperly terminated by the Orlando company on Sept. 3, 2014, after undergoing back surgery in the previous month. The suit says he was terminated on grounds of excessive absences, despite the suit's claim that his absence from work was in keeping with FMLA protocol. The plaintiff is alleging violation of the FMLA, the Americans with Disabilities Act and the Florida Civil Rights Act.

The plaintiff seeks compensation for lost wages and salary, front pay, employment benefits, pre-judgment and post-judgment interest, reasonable attorneys' fees and costs and all other relief that is just and equitable. He is represented by Daniel A. Perez of Hogan & Hogan, P.A. in Orlando.
