MIAMI – A woman is suing her insurance company in a dispute over disability benefits.
Marie Spencer filed a complaint on March 4 in the U.S. District Court for the Southern District of Florida against Life Insurance Co. of North America alleging that the insurance company violated the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she became disabled on from Sept. 1, 2014, and filed a claim for long-term disability benefits to the defendant. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly has refused to pay her benefits, failed to provide a reasonable explanation for the termination of her claim and failed to properly investigate the merits of her claim.
The plaintiff seeks the following: an order declaring that she is entitled to immediate reinstatement to the plan; compensation for disability benefits due, attorneys’ fees and costs, prejudgment and post-judgment interest; and any further relief that the court may deem just and proper.
