Insurance companies sue transportation company after boat was allegedly damaged

TAMPA – Two insurance companies and a common carrier are suing a transportation company over claims it failed to take reasonable precautions in transporting a 2014 Cruiser Yachts 48 Cantius from Illinois to Florida.

XL Specialty Insurance Co. & Aspen Specialty Insurance Co., as subrogees of Galati Yacht Sales LLC, filed a complaint on March 3 in the Tampa Division of the Middle District of Florida against William Joule Marine Transport Inc., citing breach of contract and negligence.

According to the complaint, the plaintiffs allege that they sustained damages by virtue of paying a substantial amount of money to resolve Galati Yacht Sales' property damage claim. The plaintiffs hold William Joule Marine Transport Inc. responsible because the defendant allegedly failed to deliver the vessel to Galati Yacht Sales in good condition, failed and refused to pay for the damaged vessel, and breached its duty when its driver passed under a bridge with insufficient clearance for the vessel and damaged it.

The plaintiffs seek the following: compensation for damages in the amount of $523,755, plus interest, costs for this action and any further relief that the court may deem just and proper. They are represented by Robert B. Birthisel, Jules V. Massee, Stacey L. Papp and Michael E. Spain of Hamilton, Miller & Birthisel LLP in Tampa.
