Windshield wiper blade maker sued over alleged contract breach

Lawsuit

MIAMI — A windshield-wiper blades distributor is suing a manufacturer of wiper blades for alleged breach of contract.

Winplus North America Inc., a California-based company, and Winplus Company Ltd., of Hong Kong, are suing Scantop Enterprise Company Ltd., a wiper blades manufacturer in Hong Kong.

The Winplus plaintiffs sued on March 1 in U.S. District Court for the Southern District of Florida, claiming that Scantop breached a California unconfirmed arbitration award of nearly $1.3 million by failing to pay the amount within the required time frame.

The suit claims that the defendant failed to pay the arbitrated amount of $1,297,835.87, plus interest.

The plaintiffs seek the following: compensation for damages in the amount of $1,297,835.87, pre-judgment and post-judgment interest, attorneys’ fees and costs, and such further relief as the court may deem just and proper. They are represented by Adam G. Rabinowitz and Christina Lehm of Broad and Cassel in Fort Lauderdale.
