Child's guardians sue government over negligence allegations

FORT MYERS — A child's natural guardians are suing the federal government, claiming employees of a federally supported health center did not provide proper care during childbirth, leading to disabilities for the child.

Yoandry Garcia and Cassandra Drake are suing the United Sates of America, citing alleged negligence.

The natural guardians filed a complaint on March 1 in U.S. District Court for the Middle District of Florida Fort Myers Division against the United Sates of America, alleging that government employees fell short in their duties on Aug. 15, 2014, by not performing an emergency C-section, among other claims..

The child continues to have numerous disabilities and medical problems related to negligence, the suit claims. The plaintiffs seek compensation for damages amounting to $30 million, costs for this action and any further relief that the court may deem just. They are represented by Craig R. Stevens of Morgan & Morgan, P.A. in Fort Myers.
