Rykies allegedly copied an ornamental zipper design from Saferest

MIAMI — A mattress encasement manufacturer has filed suit against another business for allegedly copying its ornamental mattress zipper.

Saferest LLC filed a complaint Feb. 25 in U.S. District Court for the Southern District of Florida against Rykies LLC, alleging that the company violated U.S. patent law by infringing the design of its 414 patent.

According to the complaint, the plaintiff alleges that it suffered and will continue to suffer irreparable injury, unless the defendant is restrained by the court. The plaintiff holds Rykies LLC responsible because the defendant allegedly manufactured, imported and sold mattress encasement products with an identical zipper cover with the same ornamental design.

The plaintiff seeks compensation for damages it has suffered, pre-judgment interest, attorneys' fees and costs and any further relief that the court may deem just and equitable. The plaintiff is represented by John Fulton Jr., John Cyril Malloy III and Oliver A. Ruiz of Malloy & Malloy P.L. in Miami.
