Chef sues restaurant, president for allegedly unpaid wages

MIAMI – A chef is suing a restaurant and its president over allegations that he wasn't paid overtime.

Edgar Nava Martinez filed complaint Feb. 16 in the U.S. District Court for the Southern District of Florida against the La Haciendita Grocery Inc., doing business as Mexico Lindo Restaurant and Bar, and Clarivel Esquivel, its president, alleging that they knowingly violated the Fair Labor Standards Act and and Florida Minimum Wage Act.

According to the complaint, the plaintiff alleges that he did not receive minimum wage and overtime compensation. The plaintiff holds Mexico Lindo Restaurant and Bar and Esquivel responsible because they allegedly failed to pay the proper wages as required by the state and federal law.

The plaintiff seeks the following: compensation for back wages, general and liquidated damages, prejudgment interest, attorney’s fees and costs and any further relief that the court may deem just and proper. He is represented by Cathleen Scott of Scott Wagner & Associates PA in Jupiter.
