Man sues insurance company over alleged denial of benefits

MIAMI – A former general manager at Friendly's is suing an insurance company over claims it wrongfully denied him disability benefits.

Ralph Carroll filed a complaint Feb. 10 in the U.S. District Court for the Southern District of Florida against Life Insurance Co. of America, alleging that the insurance company knowingly violated the Employee Retirement Income Security Act by terminating his claim.

According to the complaint, the plaintiff alleges that, from Jan. 12, 2015, to the present, he has not received disability benefits under his policy. The plaintiff holds Life Insurance Co. of America responsible because the defendant allegedly refused to pay benefits due to him.

The plaintiff seeks the following: compensation for disability benefits due, attorneys’ fees and costs, pre-judgment and post-judgment interest and any other relief that the court may deem just and proper. He is represented by Cesar Gavidia and Gregory M. Dell of Attorneys Dell & Schaefer Chartered in Hollywood.
