M&T Bank Corp. sued over alleged fee dispute

Overdue

MIAMI – A Miami-Dade County resident is suing debt collector over alleged fees.

Jose Quintana filed a complaint Feb. 5 in the U.S. District Court for the Southern District of Florida against M&T Bank Corp., alleging that the debt collector knowingly violated the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that M&T Bank Corp. threatened to charge a late fee for an undue amount and that it charged a foreclosure attorney fee after the plaintiff entered into a Home Affordable Modification Agreement.

The plaintiff seeks the following: compensation for actual and statutory damages, reasonable attorney’s fees and costs and any other relief that the court deems just and proper. He is represented by Aaron Silvers and Yechezkel Rodal of Loan Lawyers LLC in Fort Lauderdale.
