Double A Metal Works Inc. sued for allegedly not paying overtime

MIAMI — A former employee of Double A Metal Works is suing the company alleging they failed to unpay him paid overtime wages in violation of the Fair Labor Standards Act (FLSA).

Luis Cala filed a federal claim on Jan. 7 in the US District Court for the Southern District of Florida Miami Division against Double A Metal Works Inc. and Ayelen Lugo, citing overtime wage violations under the FLSA.

According to the claim, Cala worked for the Florida corporation, under the supervision of registered agent Lugo, from approximately Jan. 2013 through Sept. 2015. Cala alleges his rate of pay incrementally increased from $8.00 per hour to $11.00 per hour during his time of employment. The plaintiff claims that over the employment period, he worked approximately 1,900 hours in excess of his regular forty hour work week without receiving overtime pay equal to one and a half times his regular pay rate. Cala avers the defendant’s disregard was a willful violation of the FLSA.

Cala demands a trial by jury and seeks double damages and attorneys fees to be proven at the time of trial, court costs, and interest. He is represented by Ricardo R. Corona of the Corona Law Firm in Miami, Florida.
