Pipe manufacturer employee sues Spears Coastline claiming FLSA violation

JACKSONVILLE – A Nassau County man is suing Spears Coastline Plastics, alleging the chlorinated polyvinyl chloride (CPVC) pipe manufacturer intentionally neglected to pay for owed overtime.

Clinton Quering filed a lawsuit Jan. 15 in the U.S. District Court of the Middle District of Florida, Jacksonville Division against Spears Coastline Plastics LLC and Spears Manufacturing Co., citing failure to pay overtime compensation in violation of the Fair Labor Standards Act.

According to the claim, Quering began working for the defendant in October 2014. The plaintiff was hired to stack CPVC pipe, check for defects and cut, bag, clean and load the pipe, the complaint states. Quering alleges that from November 2014 to April, the defendants failed to compensate him at a rate of one-and-one-half times the regular rate for all hours worked in excess of 40 hours in a single workweek, violating the FLSA.

The plaintiff claims that the defendants deducted 30 minutes for breaks of less than 20 minutes, breaks which should be added to hours worked according to the FLSA. He avers that the plaintiff knowingly avoided paying all of his wages for unjust enrichment, and he states that the complaint is subject to amendment for a collective, should additional employees come forward.

Quering seeks a trial by jury for actual damages, compensatory damages and/or restitution, costs and attorney’s fees. He is represented by Angeli Murthy of Morgan & Morgan PA in Plantation.
