The Estate of Delores A. Demember, represented by Jacqueline A. Walter, has filed a lawsuit against Suncoast Manor Retirement Community Inc., Westminster Services, Inc., and Luz Negroni Wilson, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida. The case ID is 24-001426-CI and was filed on March 29, 2024. The plaintiff alleges negligence on the part of the defendants resulting in damages exceeding $50,000.

The complaint details that Delores A. Demember was admitted to Westminster Suncoast, an assisted living facility owned by Suncoast Manor Retirement Community Inc., on December 12, 2021. She remained there until her discharge on July 21, 2022. The plaintiff further alleges that Westminster Services Inc., contracted by Suncoast Manor Retirement Community Inc., failed to exercise reasonable care according to §429.29(3), Florida Statutes.

Luz Negroni Wilson is identified as the Administrator at Westminster Suncoast during Delores' residency and is accused of failing to ensure compliance with all Federal, State, Local laws and professional standards for the facility. It's important to note that the plaintiff clarifies they are not pursuing any COVID-19-related claims as defined by sections 768.38 and 768.381 of Florida Statutes.

The plaintiff seeks judgment for non-lethal negligence damages against all defendants for violations of residents’ rights pursuant to Florida Statute 429.28.
