Raskin Industries sues Hyundai L&C USA for defective flooring products

In a lawsuit filed in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, Raskin Industries, LLC is suing Hyundai L&C USA, LLC. The case number is 502024CA002836XXXAMB Div: AG and was filed on March 27, 2024. The complaint revolves around allegations of breach of contract, breach of warranty, breach of implied warranty, and negligence related to the manufacturing and delivery of defective flooring products.

Raskin Industries alleges that Hyundai L&C USA delivered defective flooring products directly to their customers between 2019 - 2023 amounting to over $10 million. The plaintiff claims that the manner in which these products were delivered made it impossible for them or their distributors to identify the defects before installation.

The flooring products were allegedly defective due to being out of square, banana bowed, exhibiting cupping, inconsistent sheen and surface blemishes. These defects reportedly rendered the products unfit for installation as installers could not align the planks. As a result, Raskin Industries' distributors and customers incurred substantial expenses and delays including increased labor costs for installing and subsequently removing the defective flooring products.

Raskin Industries is seeking damages for breach of contract and negligence from Hyundai L&C USA. They allege that they had to deliver additional flooring products to replace the defective ones or have entire shipments returned after incurring expenses for removing already installed defective products. In one instance in November 2023, Raskin Industries reimbursed its distributor approximately $120,000 for over 4,000 cartons of defective flooring product purchased from Hyundai L&C USA.
