AAA sues car sales company for trademark infringement

The American Automobile Association (AAA) is suing a Florida car seller for trademark infringement.

AAA filed its complaint in federal court against AAA Car Sales Inc., which is based in Miami.

According to the complaint, AAA Car Sales has been using the plaintiff's federally registered trademark AAA in connection with its auto repair services marketing and sales activities without authorization. This alleged unauthorized use constitutes an infringement under Section 32 of the Lanham Act and unfair competition under Section 43(a) of the same act as well as under common law.

AAA says it has held its trademark since 1965 and uses it in connection with various automobile-related services. The plaintiff claims the defendant's actions will continue unless stopped by court intervention. AAA seeks to have these activities enjoined by the court.
